Southern and Eastern Africa Chief Justices’ Forum Strengthens Focus on Judicial Independence and Accountability

The Acting President and Minister of Finance, Ndaba Nkosinathi Gaolathe, officiated at the Southern and Eastern Africa Chief Justices’ Forum (SEACF) yesterday afternoon. The three-day event brought together judicial leaders from 14 member jurisdictions to discuss how courts can remain both independent and accountable while safeguarding the rule of law.

The forum, themed “Judicial Independence and Accountability in Safeguarding the Rule of Law,” examined the evolving challenges facing judicial systems in the region. Key discussions explored how courts can secure financial independence, improve transparency, and adapt to modern challenges such as artificial intelligence and digital justice systems.

One of the central debates centered on “Power and the Purse: Is Financial Independence a Reality or a Myth?” Participants addressed how budgetary constraints and executive influence can undermine judicial operations. Another discussion, “Accountability Without Undermining Independence,” focused on how to create oversight mechanisms that preserve integrity without political interference.

In his closing remarks, Mr. Gaolathe commended the judiciary for its dedication to fairness and public service. He described judges as “faithful stewards of justice, fiercely impartial and courageously principled.” He emphasized that true judicial strength lies in balancing freedom with responsibility.

“A judiciary that is independent but unaccountable risks losing public trust. One that is accountable but not independent risks losing its soul,” he said. His words resonated with participants who acknowledged the complex reality of maintaining both principles in governance.

Delegates resolved to enhance judicial autonomy through stronger institutional frameworks, transparent financial management, and continuous professional development. The forum also agreed to invest in capacity-building initiatives that support Alternative Dispute Resolution and AI-related judicial processes. These efforts aim to make justice delivery more efficient and accessible.

The SEACF reaffirmed its commitment to protecting the rule of law across Southern and Eastern Africa. By fostering collaboration among member states, the forum seeks to ensure that courts remain impartial guardians of justice and active partners in regional development.
