Kgosi granted bail

Former spy chief, Isaac Kgosi will not be spending tonight behind bars after spending three (3) nights in police custody. Kgosi will be spending a night at home after being granted bail by village magistrate court earlier today.

Represented by Tshiamo Rantao among others, the state wanted Kgosi to be remanded. The state argued that Kgosi might temper with witnesses, and the case since he is a former intelligence boss, hence still has connections in the civil service. Moreover, the state argued that the charges which Kgosi is facing are severe which can land him up to twenty-five (25) in jail if found guilty.

On the other side, Kgosi’s lawyers argued that accessions and fear brought by state should not be used to deny Kgosi bail. The defense side stated that there is no evidence that the accused will not stand trial. Moreover, they brought to the court’s attention that Kgosi has health problems which needed attention on Monday.

Delivering her verdict, Judge Lindiwe Makgoro said there is no compelling reason to remand the accused while investigations are still at infant stage. Judge Makgoro said allegations of fear as speculated by the prosecution do not suffice in court. Kgosi is set to appear on the 7th of December to pay up P5000 for his bail. He has been asked to comply with all the court orders.

As the plot around Kgosi’s case thickened, there were reports that Judge Zein Kebonang was spotted at Kgosi’s residence on Sunday, and at Tafila Attorneys (Kgosi’s lawyers) on Monday.

Kebonang brothers has since refuted the allegations. Advocate Sadique Kebonang, Judge Zein Kebonang’s twin brother said it was he who was spotted, not Zein.

“On Sunday I visited Kgosi’s house to offer my sympathy to Kgosi’s wife. I met two DIS officials. On Monday, i went for a different appointment at Tafila’s office. I stayed less than 2 minutes as I found him busy. I found at the offices DIS officials whom i greeted. I am a practising advocate in Botswana and if i had been asked to represent Kgosi, i would have. Let us not sacrifice the truth for expedience. It is clear that the write up is malicious and intended to achieve a particular narrative.” Advocate Sadique Kebonang clarified.

For his part, Judge Zein Kebonang rubbished allegations saying it is not possible as he left Botswana on Saturday for United Kingdom.

“The allegations regarding my person, my attendance at Kgosi’s place on sunday or even at Tafila’ office on Monday are false and malicous. I am currently in Reading, having left Botswana on Saturday. You can verify this information with Air Botswana and Immigrations. If the writer of the article is confident of his story, let him identify him/herself and not be faceless.” he wrote.
